About Brogota

The Brogota - Access and Benefit-Sharing Around the World

Brazilian Law in Contrast with International Regulations results from an exhaustive study that aims to identify and catalog access and benefit-sharing (ABS) regulations in 198 countries. This study, aimed at users of genetic resources, is based on the concerns and interests of the industry, as well as researchers, the public sector, and other stakeholders. Its objective is to facilitate the identification of the legal framework for ABS at a global level. In this way, the study helps to clarify the obligations that must be met according to each country’s legislation and in compliance with the Nagoya Protocol. In partnership with Natura &Co and CNI - the National Confederation of Brazilian Industry, the study was launched at COP 13 in Mexico, and the event was attended by representatives from 80 nationalities.

Along with other topics and solutions from GSS, the platform has a positive impact on the activities of organizations and, consequently, on nature, with great potential for societal change, both public and private. Companies and users of genetic resources can better understand the legal pathways to conduct their activities in a legal and biodiversity-conscious way.

Since 2016, the study has been published and periodically updated on the ABS Clearing House website. In recognition of the demand for innovation and automation in users’ information searches, for 2024 the study was transformed into a digital platform that consolidates the content along with various other features, improving the experience for users and professionals who seek better ABS management on their daily activities.

As a project aligned with the Convention on Biological Diversity and other standards and frameworks, and following the goals of the Global Biodiversity Framework, Brogotá is a tool that can be used as a foundation to define strategies and pathways to achieve Goal 13: Facilitating access to genetic resources and sharing the benefits fairly and equitably; and Goal 15: Integrating biodiversity into the strategies and practices of the private sector that impact or depend on nature.

Initially, the project was commissioned by Natura (2016-2022), followed by CNI - the National Confederation of Brazilian Industry (2016 + 2018), and later by Croda (2020-2022). In its third edition, the partnership continued with Natura and Croda (2022). In 2024, we continue the partnership with Natura and CNI, and to further enhance and enrich the work, we have the support of Amyris and TozziniFreire Advogados.

The Platform

In its 4th edition, the Brogota platform introduces innovation by offering a technology that makes it more accessible. It provides fast and up-to-date access to access and benefit-sharing (ABS) regulations worldwide, featuring customizable filters, intuitive navigation, comparison tools, and detailed legal analysis*, facilitating the management of all ABS requirements. 
 

With compliance tools, users can make more efficient decisions and risk assessments, receive automatic notifications about legislative changes, and benefit from resources for political and institutional engagement in the Nagoya Protocol negotiations. 
 

The platform also grants autonomy in managing biodiversity-related activities, ensuring compliance with local ABS legislation while providing access to updated information, forms, news, and essential contacts for safe and efficient management. Designed with professionals specialized in ABS legal frameworks, it offers an integrated view of the regulations affecting their operations, covering different regions.

2016

Launch of the Brogota - Access and Benefit-Sharing Around the World: The Brazilian Law Contrasted with International Regulations during the COP 13, in Cancun, Mexico. The side event included representatives of Natura, CNI, Beraca, the Brazilian Ministry of Environment, and the then Executive Secretary of CBD, Bráulio Dias, to discuss the challenging task of preparing the private sector to comply with multiple ABS rules.

2017

The ABS Clearing House virtual library has included Brogotá in its archives for the first time. Together with CNI, GSS launched the first version of Brogotá in Portuguese.

2022

Four years after its launch, many countries have updated their legislations, published new rules, or matured the application of their norms. Thus, the 3rd edition of Brogotá introduced relevant updates, and the side event focused on discussing the experience gained by industries and governments in applying the multiple legal frameworks worldwide.

2024

One of the biggest challenges in applying ABS regulations is dealing with transboundary species and the overlap of different legislations. To help users overcome it, GSS, in partnership with Natura, CNI, Amyris, and TozziniFreire Advocacy, launches the Brogota Platform and offers a side event to discuss the Pan-Amazonian legislation at the COP 16.
