Privacy Policy

1. Introduction

This is the Privacy Policy applied to the Brogota Platform, a search system and an automated mechanism that aims to integrate the main elements of ABS (Access and Benefit-Sharing) legislation around the world.

GSS Carbono e Bioinovação, a company registered in the CNPJ n.º 10.314.166/0001-36 (Brazilian Employer Identification Number), headquartered in Rua Bpo. Dom José, 2095, Batel, Curitiba (PR), 80440-080, Brazil, ("we", "our" or "us"), is the holder of the Brogota Platform (“Platform”, “system” or “software”).

By using our platform, you agree to the collection and use of all information in accordance with this policy. You acknowledge and agree that all data, information, content, images and any other type of materials are the property of GSS and are protected by intellectual property law. You personally commit not to use, reproduce or distribute any content from Brogota Platform, being reliable for any damage caused by unauthorized or improper use.

A service contract for the utilization of the platform must be formed between you and GSS, which will be presented and signed in case of acquisition of one of the access plans. This Privacy Policy or the Terms and Conditions of Use do not substitute the Contract for the Provision of Services and Use of the Brogota Platform.

Brogota Platform's Privacy Policy is meant to help users to understand what information we collect and how we use, disclose and safeguard personal data concerning the use of our website and services. We are strongly committed to protecting user’s privacy and ensuring a safe online experience.

2. Information We Collect

To be able to register for and use our Platform, we need to collect the following information:

  • Personal Information: If you create an account/register on our Platform to use our services or communicate with us, we may collect personal information such as your name, company registration number, and contact information (address, email address, and  phone number).
     

  • Usage Data: We collect information about your interactions with our Platform, including IP addresses, browser types, devices (computer or mobile), operating system, settings, pages visited, preferences, the date and time of your visit, cookies, and the time spent on our Platform.
     

  • Cookies and Tracking Technologies: A "cookie" is a text file containing information sent to your device by a website you visit, depending on the settings adjusted in your browser and the user's acceptance. We use cookies and similar technologies to track your activity and improve your user experience on our Platform. More information about cookies can be found on Section 7 of this Policy.
     

  • Other Information: We may collect other information that you provide to us, such as when you participate in our events or surveys or when you provide us with information to establish your identity.

3. How We Use Your Information

The information collected about you may be used for the following purposes:
 

  • Providing, administering, maintaining and/or analyzing our services;

  • Managing your account;

  • Personalizing the user experience according to user preferences;

  • Improving our Platform and developing new content, features, programs, and services;

  • Communicating and sending relevant updates, promotional materials, and other information about our services and events;

  • Ensuring security and preventing fraud, criminal activity, or misuse of our Platform and services;

  • Complying with legal obligations and protecting our rights, privacy, safety, or property, and/or those of our affiliates, users, or other third parties.
     

The user’s e-mail address will be maintained in our database and added to our mailing service in order to receive publications and news from GSS and its subsidiaries (VBIO, Repenso, and any other future subsidiaries). You may unsubscribe at any time you want by accessing your account settings.
 

We may analyze the general behavior and characteristics of users of our platform and services and share aggregated information like general user statistics with third parties, publish such aggregated information, or make such aggregated information generally available. Aggregated information is the data generated by aggregating users' data in a way that they no longer allow the identification of any individual or company. 
 

The statistical analysis includes your data in an anonymous/unidentifiable form, in compliance with Brazilian Data Privacy Law.

4. How We Share Your Information

Your personal information will not be shared with third parties, except in the following circumstances:
 

  • As required by law or court order, or where disclosure is necessary or appropriate for purposes of national security or other issues of public importance;

  • Where the processing or storage of data is necessary for the operation of our services;

  • Upon a user’s request for GSS assistance to contact a focal point, authority, or for other purposes;

  • In cases where you register using an email address belonging to your employer or another organization;

  • In connection with mergers, acquisitions, affiliations, or the sale of assets of the company responsible for the Platform.
     

We don’t show your personalized content based on sensitive categories, such as race, religion, sexual orientation, health, and others, nor share this data, if they were shared by you in any circumstances.
 

Eventual service providers are obligated to handle personal data attending to this Privacy Policy and according to our instructions, only in the course of performing their duties to us. They cannot use the shared information for their own purposes and must delete or return the personal data once they’ve fulfilled the request.
 

The Brogota Platform may contain links to third-party websites that are not operated or controlled by GSS. Any information you share with third parties through these websites will be processed in accordance with their respective Privacy Policies and Terms of Services, and not under this Privacy Policy or by GSS.

5. Data Safety and Security

In order to continuously protect your personal or company information, both online and offline, from unauthorized access, use, modification, loss, destruction or disclosure of information we implement security measures within our services. 

If any security threats are detected and we believe you should be informed, you will be notified and guided through steps to stay better protected. However, as is widely known, no online data transmission system is completely secure or error-free, and we cannot guarantee the absolute security of your information.

We will retain your information for only as long as necessary to provide our service to you or for legal, safety and security reasons, depending on factors like the amount, nature, and sensitivity of the information and the potential risk of harm from unauthorized use or disclosure. Service providers are prohibited from using the information for their own purposes.

6. User Rights

Users of Brogota Platform mainly hold the right to:
 

  • Know and access personal data and its processing methods;

  • Correct, update, transfer, restrict the processing of, and delete personal data from our data base;

  • Withdraw consent to personal data use at any time;

  • Opt-out of receiving marketing communications;

  • Object or complain to how your data is processed;

  • Not to be treated in any discriminatory manner when exercising any of your privacy rights.
     

As GSS, holder of the Platform, is headquartered in Brazil, this Privacy Policy and the Terms and Conditions of Use are governed by Brazilian law, specially the Brazilian General Data Protection Law (Lei Geral de Produção de Dados, LGPD).
 

Accordingly, if the applicable regulatory measures vary depending on the User’s location, some of the rights mentioned above may be limited to comply with the Brazilian law, for safety and security reasons and/or to protect the privacy of others, if in conflict.

7. Cookies

A "cookie" is a text file information that may include your login credentials (preventing you from logging in each time you visit the website), your preferences and settings (such as language) and record of your behavior on the Platform (helping to understand how to eventually improve services). 

We use cookies and similar technologies to track your activity, operate, and administer our services, and improve your experience as a User of the Brogota Platform. This includes content customization according to your preferences, for example.

Cookies are sent to your device by a website you visit, depending on the settings adjusted on your browser and the user's acceptance. 

Please note that refusing cookies may negatively affect the display or functionality of the platform, or certain areas or features of the website. Through your browser settings, you can usually see the cookies stored by the website, delete it if you no longer want to keep them, or even block it.

8. Policy Changes

We may update or change this Privacy Policy from time to time. You can always check the latest version of this document, indicated above.
 

Access to archived versions may be provided at any time. Additionally, your rights under this Privacy Policy will not be reduced without explicit consent. 
 

In case of significant changes, the new policy will be published on our platform, with a notification to the Users. Depending on the case, a more prominent notice will be sent by e-mail.

10. Agreement

By using the website, you agree to comply with and be bound by this Privacy Policy and by our Terms and Conditions of Use, on behalf of yourself and all members of your company/institutions and others who use any service under your account.

If you do not agree with these terms, please do not use our Platform.

11. Governing Law

This Privacy Policy is an agreement between you and GSS, a company that is organized and operates under the laws of Brazil. Therefore, this Privacy Policy is governed by and construed in accordance with Brazilian law.

By using our platform, you understand and acknowledge that your information will be processed and stored by GSS in Brazil and service providers, cloud providers, and/or affiliates in other jurisdictions.

In the event of any controversy or dispute between GSS and you arising out of or in connection with your use of the Brogota Platform, the parties shall attempt, promptly and in good faith, to resolve it extrajudicially. In case it is not possible to reach an agreement, the parties shall be free to pursue any right or remedy available to them under applicable law.

You and GSS agree that the law applicable to all disputes arising out of or relating to this Privacy Policy to access to or use of the Brogota Platform will be exclusively Brazilian law, regardless of conflict of law provisions or principles between countries. In any case, the consumer protection law is applicable, and the Brazilian one is prioritized.

Within the territory of Brazil, the jurisdiction and competent judicial forum will be that of Curitiba, Parana, where GSS has its headquarters.
