These Terms and Conditions of Use ("Terms") apply to the Brogota Platform website, located at https://www.brogota.eco/, and all associated sites linked to that URL. This document is an agreement between you (user) and GSS, defining the relationship and rules with you as you interact with our services.

Dom José, 2095, Batel, Curitiba (PR), 80440-080, Brazil, further referred to as "we", "our" or "us", which is the sole owner and holder of the Brogota Platform.

We are an Impact Development Company that empowers organizations and communities by delivering transformative climate change and biodiversity solutions through advisory, innovation, sustainable assets, and strategic program implementation. In addition to this document, our Privacy Policy explains how we collect and use personal information. Please read those two documents carefully. 

By using the website, you agree to comply with and be bound by these Terms and Conditions of Use and our Privacy Policy, on behalf of yourself and all members of your company/institutions and others who use any service under your account.

If you do not agree with these terms, please do not use our platform.

A service contract for the utilization of the platform must be formed between you and GSS, which will be presented and signed in case of acquisition of one of the access plans. These Terms and Conditions of Use and our Privacy Policy do not substitute the Contract for the Provision of Services and Use of the Brogota Platform.

By using our Platform you acknowledge and agree that all data, information, content, images and any other type of materials are the property of GSS and are protected by intellectual property law. You personally commit not to use, reproduce or distribute any content from Brogota Platform, and you shall be criminally and civilly liable for any damage caused by unauthorized or improper use of our Platform.

To access our Platform you are required to create an account. During registration, you must provide accurate and complete personal information about you (name and company registration number) and contact information (address, email address, phone number).

It is strictly prohibited to share your account password or any other login information.

If you open an account on behalf of a company, organization, institution, or other entity, you represent and warrant that you have the authority to grant all permissions and information required in these Terms and to bind the entity to these Terms.

Therefore, you and the entity are aware that “you”, in this document, includes you and the entity. You are responsible for maintaining the confidentiality of your account credentials and password, restricting access to it. In addition, you agree to accept responsibility for all activities that occur under your account or password.

You are aware that the access provided by your password to the platform, as well as its content, is granted only to the company/organization/institution/entity you represent. This means that your credentials must not be shared with other companies, even if they form the same economic group (local and global administration, for example), or any subsidiary. The number of users and access provided to the company/organization/institution/entity you represent will be restricted to the limits defined in the Contract for the Provision of Services and Use of the Brogota Platform.

You agree to notify us immediately of any unauthorized use of your account or password, or any other breach of security. GSS is not responsible for the user's misuse of the platform, including failure to keep account information and activity secure and confidential.

You agree to use our platform only for lawful purposes and under these Terms. You may access and use your services only if you are in compliance with these Terms and the Privacy Policy.

It is the user's sole responsibility to avoid and protect against unauthorized access to their password, computers, devices, and applications. We recommend using a unique password for your account that is not used for other online accounts. Ensure that you sign off when finished using a shared computer.

In case your account is registered using an email address owned by a company, organization, or other entity (for example, your employer), it may be linked to the organization's business account with us. You are  aware that your activity or access can be monitored or restricted in that case.

By using our platform, you may not:
 

• Use our services or content for any illegal, harmful, and/or abusive purposes or activities;

• Pretend to be or represent someone else, or impersonate any other individual or entity.

• Violate any applicable laws, regulations, or third-party rights;

• Use anyone else’s account or password at any time;

• Modify, copy, reproduce, lease, sell, or distribute any part of our services or content;

• Engage in any activity that interferes with or disrupts the operation, proper functioning or security of our platform or any transaction conducted on the website;

• Circumvent any rate limits or restrictions or bypass any protective measures or safety mitigations of the platform;

• Attempt to gain unauthorized or illegitimate access to any part or feature of the platform that is  restricted to your account;

• Use any automatic device, program, algorithm, technology, or methodology to extract data or content from the Brogota Platform;

• Artificially or manually extract data or decode, trace, or reverse engineer the underlying components of our services to develop models that compete with the Brogota Platform.
   

GSS reserves the right to apply penalties to users and to stop the activities described above, in  accordance with the severity of the identified actions, as set forth in Item 6 of these Terms.

All content and materials on our platform, including text, graphics, logos, and software, are the property of GSS and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from our platform without our prior written permission.

You are aware that, as a user and subscriber to access plans, you are prohibited from taking screenshots of the content of the page, using data copying mechanisms (any automatic device, program, algorithm or methodology, artificial or manual) or reverse engineering, as well as disclosing the paid content on the internet, media or any other form of sharing our study.

​

The mentioned platform privacy and intellectual property violations are subject to penalties and legal liability, including applicable compensation and fines.

We implement security measures into our services to continuously protect your personal or company information from unauthorized access, use, modification, loss, destruction, or disclosure of information we hold, both online and offline.

You will be notified and guided through steps to stay better protected if any relevant security threats are detected. However, as no online data transmission system is completely secure or error-free, we cannot guarantee the absolute security of your information.

​

We will retain your information only as long as necessary in order to provide our service to you or for legal, safety and security reasons, depending on factors like the amount, nature, and sensitivity of the information and the potential risk of harm from unauthorized use or disclosure.

If we believe that you have violated these Terms and Conditions of Use or, in the presence of a legal requirement or court order, we reserve the right to suspend or terminate your access to Brogota Platform at our sole discretion, with or without notice.

In addition to the circumstances already described above, your account may also be disabled, with advance notice, if:

• Your activity is considered risky or harmful to Brogota Platform, GSS, the platform users, supporters, or anyone else;

• Your profile has been inactive for over 1 year;

• You shared any content or gave access to your password or profile to unauthorized people or entities.

• Other circumstances not covered by this document, according to a reasonable criterion.

The mentioned platform privacy and intellectual property violations are subject to penalties and legal liability, including applicable compensation and fines.

If you believe your account has been suspended or terminated in error, please contact us at brogota@gss.eco.

You are free to decide to terminate or deactivate your account and discontinue the use of our services and platform at any time. In that case, we would appreciate knowing your reasons and complaints, which can be sent through our contact channel or by email (suport@gss.eco).

Closing your account will not terminate any payment due. Please check the Contract for the Provision of Services and Use of the Brogota Platform to see the conditions and rules on closure procedures and payments.

​

Finally, your account's level of access to the platform content may be downgraded due to the lack of payment of the plan acquired or by user’s requirement. The conditions of each plan of access are regulated by the Contract for the Provision of Services and Use of the Brogota Platform.

We may update or change these Terms and Conditions of Use from time to time. The date of the last version of this document is indicated above, and you can request access to archived versions for your review. Your rights under these Terms will not be reduced without your explicit consent.

In case of significant changes, the new policy will be published on our platform and the user will be notified. The continuous use of the platform after the publication of changes will be considered as acceptance of its new Terms.

These Terms and Conditions of Use are an agreement between you and GSS, a company that is organized and operates under the laws of Brazil. Therefore, these Terms and Conditions of Use and the Privacy Policy are governed by and construed in accordance with Brazilian law.

By using our platform, you understand and acknowledge that your information will be processed and stored by GSS in Brazil and service providers, cloud providers, and/or affiliates in other jurisdictions.

​

In the event of any controversy or dispute between GSS and you arising out of or in connection with your use of the Brogota Platform, the parties shall attempt, promptly and in good faith, to resolve it extrajudicially. In case it is not possible to reach an agreement, the parties shall be free to pursue any right or remedy available to them under applicable law.

​

You and GSS agree that the law applicable to all disputes arising out of or relating to these Terms and the access to or use of the Brogota Platform will be exclusively Brazilian law, regardless of conflict of law provisions or principles between countries. In any case, the consumer protection law is applicable, and the Brazilian one is prioritized.

​

Within the territory of Brazil, the jurisdiction and competent judicial forum will be that of Curitiba, Parana, where GSS has its headquarters.
